This Website is provided solely to assist users in gathering travel information, rates of travel-related issues, engaging in interactive travel blogs, searching for and booking travel reservations, and for no other purposes.

The terms “we”, “us”, “our” “this website” and “Mykonos Traveller” refer to “TRAVEL KEY” (Registration No: 163270803000), a full-service online travel agency (Member of Greek Tourism Organization with Licence Number: 1173E70001142001) and/or our subsidiaries based in Greece. The term “you” refers to the customer visiting the Website and/or contributing content to this Website.

This Website is offered to you conditioned upon your acceptance without modification of any/all the terms, conditions, and notices set forth below (collectively, the “Agreement”). By accessing or using this Website in any manner, you agree to be bound by the Agreement and represent that you have read and understood its terms. Please read the Agreement carefully, as it contains information concerning your legal rights and limitations on these rights, as well as a section regarding applicable law and jurisdiction of disputes. We may change or otherwise modify the Agreement in the future, and you understand and agree that your continued access or use of this Website after such change signifies your acceptance of the updated or modified Agreement. As a condition of your use of this Website, you warrant that (i) all information supplied by you on this Website is true, accurate, current and complete, (ii) if you have a Mykonos Traveller account, you will safeguard your account information and will supervise and be completely responsible for any use of your account by anyone other than you and (iii) you are 13 years of age or older in order to register for an account and contribute to our Website. Mykonos Traveller does not knowingly collect the information of anyone under the age of 13. We retain the right at our sole discretion to deny access to anyone to this Website and the services we offer, at any time and for any reason, including, but not limited to, for violation of this Agreement. By using our Website and services, including any Mykonos Traveller products or services that facilitate the sharing of Content from third party sites, you understand that you are solely responsible for any information that you share with us.

In certain circumstances we may disclose information about you to third parties if we determine, in our sole discretion, such disclosure is necessary (a) to protect Mykonos Traveller’s systems, assets, employees, members and customers; (b) to ensure the integrity and operation of Mykonos Traveller’s business and systems; or (c) to comply with legitimate and enforceable governmental requests, subpoenas or court orders. We may choose to comply with or disregard such requests or orders in our sole discretion.

Mykonos Traveller’s right to disclose information, including but not limited to user profile information (i.e. name, email address, etc.), IP addressing and traffic information, usage history, and posted Content, shall take precedence over any terms of Mykonos Traveller’s Privacy Policy.

REVIEWS, COMMENTS AND USE OF INTERACTIVE AREAS

We appreciate hearing from you. Please be aware that by submitting content to this Website by email, via any Mykonos Traveller synchronization product, postings on this Website or otherwise, including any content that is transmitted to your Mykonos Traveller account by virtue of any Mykonos Traveller product or service, hotel reviews, questions, photographs or videos, comments, suggestions, ideas or the like contained in any submissions (collectively, “Submissions”), you grant Mykonos Traveller and its affiliates a nonexclusive, royalty-free, perpetual, transferable, irrevocable and fully sub-licensable right to (a) use, reproduce, modify, adapt, translate, distribute, publish, create derivative works from and publicly display and perform such Submissions throughout the world in any media, now known or hereafter devised, for any purpose; and (b) use the name that you submit in connection with such Submission.

You acknowledge that Mykonos Traveller may choose to provide attribution of your comments or reviews at our discretion. You further grant Mykonos Traveller the right to pursue at law any person or entity that violates your or Mykonos Traveller’s rights in the Submissions by a breach of this Agreement. You authorize Mykonos Traveller to make copies of Submissions as it deems necessary in order to facilitate your use of its Website and available products. You acknowledge and agree that Submissions are non-confidential and non-proprietary.

This Website may contain discussion areas, bulletin boards, review services or other forums in which you or third parties may post reviews of travel experiences or other content, messages, materials or other items on this Website (“Interactive Areas”). If Mykonos Traveller provides such Interactive Areas, you are solely responsible for your use of such Interactive Areas and use them at your own risk. By using any Interactive Areas, you expressly agree not to post, upload to, transmit, distribute, store, create or otherwise publish through this Website any of the following:

As a provider of interactive services, Mykonos Traveller is not liable for any statements, representations or Content provided by its users in any public forum, personal home page or other Interactive Area. Although Mykonos Traveller has no obligation to screen, edit or monitor any of the Content posted to or distributed through any Interactive Area, Mykonos Traveller reserves the right and has absolute discretion, to remove, screen, translate or edit without notice any Content posted or stored on this Website at any time and for any reason, or to have such actions performed by third parties on its behalf, and you are solely responsible for creating backup copies of and replacing any Content you provide to us or store on this Website at your sole cost and expense.

If it is determined that you retain moral rights (including rights of attribution or integrity) in the Content, you hereby declare that (a) you do not require that any personally identifying information be used in connection with the Content, or any derivative works of or upgrades or updates thereto; (b) you have no objection to the publication, use, modification, deletion and exploitation of the Content by Mykonos Traveller or its licensees, successors and assigns; (c) you forever waive and agree not to claim or assert any entitlement to any and all moral rights of an author in any of the Content; and (d) you forever release Mykonos Traveller, and its licensees, successors and assigns, from any claims that you could otherwise assert against Mykonos Traveller by virtue of any such moral rights.

Any use of the Interactive Areas or other portions of this Website in violation of the foregoing violates the terms of this Agreement and may result in, among other things, termination or suspension of your rights to use the Interactive Areas and/or this Website.

PRODUCTS, SERVICES AND BOOKING RESERVATIONS THROUGH MYKONOS TRAVELLER

Mykonos Traveller provides the Platform through which you can enter into a contract with a third party supplier of a Product (“Supplier”). Mykonos Traveller is not a supplier of any Product, and your contract for supply of any Product you Book will be directly between you and the applicable Supplier.

In respect of each Booking, Mykonos Traveller acts as a disclosed agent on behalf of the Supplier, meaning that a Product listing represents an invitation to you to make an offer to a Supplier, and that we are free to accept or reject such offer on behalf of that Supplier. These Terms of Use govern your use of the Services, which includes your use of the Platform through which you may make such an offer to a Supplier. However, the provision of the Product you Book will be subject to the terms and conditions displayed on the Website in respect of such Product, any information made available to you during the Booking process, and the terms and conditions of the Supplier with whom you have a legal contract for the supply of the Product. If you have a question about a Product that is not answered in the information on the Website and where the answer to your question may influence whether you would like to proceed to Book (including but not limited to whether a Supplier is able to accept accompaniment by a pet or service animal), it is your responsibility to contact Mykonos Traveller prior to making a Booking and to obtain an answer to your question. Once you have made a Booking, you are subject to the cancellation policy as stated in the Product listing.

If you make a Booking, you agree to review and be bound by the applicable Supplier’s terms and conditions and any other rules or policies related to the Product (the “Supplier Terms”). Notwithstanding the foregoing, to the extent that the Supplier Terms conflict with these Terms of Use in respect of your legal relationship with Mykonos Traveller, these Terms of Use shall prevail. Your interactions with Suppliers are at your own risk. Mykonos Traveller will have no liability with respect to the acts, omissions, errors, representations, warranties, breaches or negligence of any Supplier or for any personal injuries, death, property damage, or other damages or expenses resulting from your interactions with any Supplier.

Mykonos Traveller does not provide or own any Experiences. Although Mykonos Traveller provides the Website with information about Products and facilitates Bookings, such actions do not in any way constitute Mykonos Traveller’s sponsorship or approval of such Suppliers, or any affiliation between Mykonos Traveller and any Supplier. Although Mykonos Traveller Members may rate and review particular Products based on their own experiences, Mykonos Traveller does not endorse or recommend any Products. You agree that Mykonos Traveller is not responsible for the accuracy or completeness of information it obtains from Suppliers and/or that is displayed on the Website.

By making a Booking, you warrant that you are at least 18 years of age, that you possess the legal authority to enter into both this binding agreement and a binding agreement with the Supplier, to use the Services, to purchase the Product, and that all information you supply is true and accurate. You further agree that you will use the Platform to make only legitimate Bookings for you and/or others for whom you are legally authorized to act.

PRICING

The price of each Product will be quoted on a per-person basis, unless otherwise specified.

Prices are based on the local tariff at the time of quoting, converted at the prevailing foreign-exchange rate as determined by Mykonos Traveller.

Price quotations are subject to change without notice, until a Booking has been made.

Unless the Supplier has otherwise specified, prices do not include any local taxes or use-fees, including foreign departure, security, port charges, park fees, customs, immigration, agricultural, passenger-facility charges or international transportation tax.

Inclusions are determined by the Supplier. Prices do not include tips/gratuities; passport and visa fees; baggage and personal insurance; any items of a personal nature; taxes or duties; and any beverages or food not specifically stated as included by the Supplier.

CURRENCY CONVERSIONS

All prices are quoted in Euro. If Mykonos Traveller provides a currency converter, currency rates are based on various publicly available sources and should be used as guidelines only. Rates are not verified, and actual rates may vary. Currency quotes may not be updated on a daily basis, and Mykonos Traveller and its affiliates do not warrant or guarantee accuracy. Mykonos Traveller shall not be liable to you if prices change due to currency fluctuations.

PAYMENTS

When you make a Booking, Mykonos Traveller will collect your payment information and will process your payment. In doing so, Mykonos Traveller or Trave Key Limited acts as the limited payment collection agent of the Supplier, collecting your payment for the applicable Product(s) on behalf of such Supplier. Full payment is required to make a Booking, unless otherwise specified.

Payments can be made via Bank Wire transfer, Credit or Debit Card and PayPal. Payments with Credit or Debit card have an additional surcharge of 3.5% for VISA or Mastercard and 4% for Amex unless otherwise specified. Payments with PayPal have an additional surcharge of 3.5% unless otherwise specified. The payee may be referenced as Mykonos Traveller/Travel Key on your statement.

The value of your Booking may be subject to taxes, duties, foreign transaction, currency exchange or other fees. Your bank or payment card company may convert the payment into the local currency and may charge fees, resulting in differences between the amount displayed through the Platform, and the final amount charged to you. Mykonos Traveller recommends that you contact your bank or card company if you have any questions concerning any applicable currency conversion or fees.

PAYMENT PROCESSING

Under these Terms of Use, the payment processing services for the Services/Products offered are provided by Mykonos Traveller, or Travel Key. The registered office address of Mykonos Traveller and Travel Key is Potamos Evaggelistraki, PO BOX 613, Mykonos 84600, Greece.

If your payment was processed by Mykonos Traveller, or Travel Key the Terms of Use constitute an agreement between you and Mykonos Traveller. If your payment was processed by any third-party supplier directly (like Booking.com, Viator, Expedia, etc.) then the Terms of Use of each Supplier apply.

MODIFICATIONS OR CANCELLATIONS BY YOU

Once a Product has been purchased, your Booking cannot be changed by you or cancelled with a refund, unless otherwise stated in the terms and conditions applicable to such Product. If you request that any element of your Booking is changed (including but not limited to your pick-up location or time), you acknowledge that it is entirely at the applicable Supplier’s discretion as to whether to accommodate your request. It is your responsibility to be at the meeting place at the time and date communicated on your Booking. In the case of certain Products, exact locations and times will be communicated to you after your Booking is made by the applicable Supplier via Mykonos Traveller’s messaging systems (email, WhatsApp, Messenger, etc.). It is your responsibility to check such messages after your Booking is made, and to be at the meeting place at the time and date that are communicated by the Supplier. If you are not at such meeting point at the required time, the Supplier may offer to accommodate you at an alternative time and date. However, the Supplier shall be under no obligation to do so, and your failure to be at the communicated meeting point at the required time may result in your Booking being classified as a “no show”, meaning that you will not be entitled to any refund or to being rebooked.

The standard cancellation policy allows you to request a change to and/or cancel a Booking up until 24 hours before the start time of the Booking; or if the Experience does not have an explicit start time, the deadline to request a change or to cancel will generally be 11:59pm, two days before the start date. Timings are calculated in accordance with the time zone of the Experience. In that case the full amount will be refunded minus any banking or processing fees. For a cancellation to be effective, it must be made in writing through email at [email protected].

If any Product is designated as ‘Non Refundable’ or with materially similar messaging (which includes but is not limited to all bookings made through our Reservations Department), it is non-refundable, and it will not be possible to change or cancel it after making a Booking. A minority of Products have other, different cancellation policies. In all circumstances, you must check the cancellation policy contained in the applicable Product listing at the time of your Booking, which is the policy that will apply to and govern the terms of your cancellation and any refunds.

Requests for modifications and amendments to a Booking, including date change requests (collectively, a “Change Request”) must be made online through email at [email protected] and if it is possible to implement a Change Request, Mykonos Traveller shall not charge a fee for doing so, as long as the Change Request is received by us by the deadline specified in the Product listing. Please note that a Supplier may charge a fee to accommodate a Change Request; in such circumstances, you will be required to pay such fee in order that Mykonos Traveller may successfully process your Change Request.

All Change Requests shall be processed by Mykonos Traveller subject to the availability and agreement of the applicable Supplier. Mykonos Traveller does not guarantee the success of any Change Request, and it shall not be successful unless Mykonos Traveller confirms that a Change Request is accepted. To the extent the Supplier is unwilling or unable to accept such Change Request, then your right to a refund (if any) shall be governed by the cancellation terms of your Booking. It is your responsibility to cancel a Booking before any deadline to cancel with a refund, even if you are waiting for a Supplier’s response to a Change Request.

If you make a Booking using a promotion code, or if you accept a discount or special-offer price during the check-out process, you may invalidate your discount or special-offer price by making a Change Request after Booking.

No refunds are available once an Experience has commenced, or in respect of any Product’s package, accommodation, meals or any other services that have started to be utilized.

OTHER MODIFICATIONS AND CANCELLATIONS

Occasionally a Supplier may make a change to a Product after your purchase, including but not limited to the date, price, inclusions, coverage, age requirements, and/or any other Product features and/or requirements. As a result, Mykonos Traveller (acting on the Supplier’s behalf), reserves the right to cancel, change or substitute any Product that you have purchased, at any time, for any reason. If the change proposed by the Supplier is material (for example, a change in dates and/or a significant change to the itinerary), and you are dissatisfied with the alternative that is offered, you will be entitled to a full refund of the original purchase price.

We may decide, in our sole discretion, that it is necessary or desirable for the protection of our interests, the Supplier’s interests and/or your interests, to withdraw our Services resulting in an override of the Product’s cancellation policy and the effective cancellation of a Booking. We may also determine, in our sole discretion, to arrange refund to you part or all of the amounts charged to you. You agree that we and the applicable Supplier shall have no liability for such cancellations or refunds.

If TRAVEL KEY is found liable for any loss or damage that arises out of or is in any way connected with your use of our sites or services, then TRAVEL KEY liabilities will in no event exceed, in the aggregate, the greater of (a) the transaction fees paid to Mykonos Traveller for the transaction(s) on this Website giving rise to the claim, or (b) One-Hundred Euro (EUR €100.00).

The limitation of liability reflects the allocation of risk between the parties. The limitations specified in this section will survive and apply even if any limited remedy specified in these terms is found to have failed in its essential purpose. The limitations of liability provided in these terms inure to the benefit of the Mykonos Traveller Media Group Companies.

Any software that is made available to download from the Mykonos Traveller websites (“Software”) is the copyrighted work of Mykonos Traveller, Mykonos Traveller affiliates, or other third-party software as identified. Your use of such Software is governed by the terms of the end-user license agreement, if any, which accompanies, or is included with, the Software (“License Agreement”). You may not install or use any Software that is accompanied by or includes a License Agreement unless you first agree to the License Agreement terms. For any Software made available for download on this Website not accompanied by a License Agreement, we hereby grant to you, the user, a limited, personal, nontransferable license to use the Software for viewing and otherwise using this Website in accordance with these terms and conditions and for no other purpose.
